1. Acceptance of Terms
By downloading, installing, or using the QuestKids mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
If you are using the App on behalf of a family, you represent that you have the authority to bind all family members to these Terms.
2. Description of Service
QuestKids is a family behavior management application that allows parents to:
- Create and manage child profiles
- Set up reward systems with points
- Assign and track chores
- Record positive and negative behaviors
- Invite co-parents or caretakers to share management
Children can access the App using a simplified interface to view their points, available rewards, and assigned tasks.
3. Account Registration
To use QuestKids, you must:
- Be at least 18 years old or the age of majority in your jurisdiction
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
You are responsible for all child profiles created under your account and for ensuring appropriate use of the App by children in your care.
4. Acceptable Use
You agree to use QuestKids only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App in any way that violates applicable laws or regulations
- Create accounts for anyone other than yourself or your family members
- Share your account credentials with unauthorized individuals
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the App to harm, abuse, or exploit children in any way
- Upload malicious content or attempt to disrupt the service
5. User Content
You retain ownership of content you create within the App (reward names, chore descriptions, etc.). By using the App, you grant us a limited license to store and process this content solely to provide the service.
You are responsible for ensuring that your content does not violate any third-party rights or applicable laws.
6. Parental Responsibility
QuestKids is a tool to assist with family management. You acknowledge that:
- The App is not a substitute for parental supervision and judgment
- You are solely responsible for parenting decisions and their outcomes
- The effectiveness of any behavior modification approach depends on consistent, appropriate implementation
- We do not guarantee any specific behavioral outcomes
7. Privacy
Your use of QuestKids is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
8. Intellectual Property
The App, including its design, features, content, and code, is owned by QuestKids and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or completely secure.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTKIDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim, if any.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or sending you a notification. Your continued use of the App after changes constitutes acceptance of the modified Terms.
12. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion.
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.
13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of California.
